NO MAUSOLEUM, MARKER, OR MONUMENT MAY BE INSTALLED PRIOR TO OBTAINING A PERMIT AT THE TOWN HALL OFFICE. FOR INFORMATION CALL 252-481-5817.

NO PLANTING OF FLOWERS, TREES, SHRUBS OR GRASS OF ANY KIND WILL BE ALLOWED WITHOUT THE APPROVAL OF THE CEMETERY SUPERINTENDENT. ANY PLANTINGS WILL BE REMOVED AND DISCARDED WITHOUT NOTICE.

ALL FRESH OR ARTIFICIAL FLOWERS MUST BE PLACED IN A VASE OR SADDLE ATTACHED TO THE MARKER AND MUST BE REMOVED WHEN THEY BECOME FADED, BROKEN AND UNSIGHTLY. IF THERE IS NO PLACE ON THE MARKER FOR FLOWERS, A CONCRETE PLANTER NOT OVER SIXTEEN INCHES IN HEIGHT WILL BE ALLOWED ON YOUR LOT FOR FLOWERS ONLY. THE TOWN SHALL NOT BE RESPONSIBLE FOR ANY FLORAL ARRANGEMENTS OR CONTAINERS PLACED IN THE CEMETERY.

NO ADMITTANCE BETWEEN DUSK AND DAWN AND ANY ACT OF VANDALISM WILL BE PROSECUTED.

TOWN OF AYDEN CEMETERY POLICY

THE BOARD OF COMMISSIONERS OF THE TOWN OF AYDEN DOES HEREBY SET FORTH THE FOLLOWING POLICIES WHICH WILL GOVERN THE OPERATION OF TOWN OWNED CEMETERIES. A COPY OF THIS POLICY WILL BE ISSUED TO EACH PERSON THAT PURCHASE A PLOT¬.

SECTION I DEFINITIONS:
THE FOLLOWING WORDS AND PHRASES SHALL HAVE THE MEANINGS RESPECTIVELY ASCRIBED TO THEM BY THIS SECTION.

  • MONUMENT: THE WORD “MONUMENT” SHALL INCLUDE A TOMB-STONE OR MEMORIAL OF GRANITE OR OTHER MATERIAL, WHICH SHALL EXTEND ABOVE THE SURFACE OF THE GROUND.
  • MARKER: THE WORD “MARKER” SHALL BE TAKEN TO MEAN A MEMORIAL FLUSH WITH THE GROUND.
  • PLOT: THE WORD “PLOT” SHALL BE TAKEN TO MEAN A SPACE OF SUFFICIENT SIZE TO ACCOMMODATE ONE ADULT INTERMENT APPROXIMATELY FOUR FEET BY TEN FEET.
  • URN: A VASE, INCLUDING LID, TO BE PLACED IN THE OPEN GRAVE INTO WHICH THE REMAINS OF A HUMAN CREMATED BODY IS PLACED AT THE TIME OF INTERMENT.

SECTION II POWERS AND DUTIES GENERALLY OF SUPERINTENDENT OF CEMETERIES:
THE DIRECTOR OF PUBLIC WORKS OF THE TOWN SHALL ACT AS SUPERINTENDENT OF TOWN CEMETERIES AND SHALL EXERCISE SUCH POWERS AND DUTIES CONFERRED UPON HIM BY THIS ARTICLE, AND ANY ORDINANCE, RESOLUTION OR ORDER OF THE TOWN MANAGER. THE SUPERINTENDENT SHALL HAVE CHARGE OF THE UP-KEEP, PROTECTION AND PRESERVATION OF THE CEMETERIES. HE SHALL BE RESPONSIBLE FOR THE DIGGING OF ALL GRAVES AND THE INTERMENT AND DISINTERMENT OF BODIES; THE ERECTION OF MONUMENTS AND MARKERS: THE PLANTING OF ANY SHRUBBERY, TREES AND FLOWERS, AND THE MAKING OF PROVISIONS FOR THE ENTRANCE AND EXITS OF PERSONS AND VEHICLES TO AND FROM THE CEMETERIES.

SECTION III INSTALLATION OF MARKERS, MONUMENTS, MAUSOLEUMS ETC.
IT SHALL BE UNLAWFUL FOR ANY PERSON TO ERECT ANY MONUMENT, MARKER, OR MAUSOLEUM IN THE TOWN CEMETERIES WITHOUT FIRST OBTAINING A PERMIT FOR SUCH ERECTION FROM THE TOWN CLERK:

SECTION IV MARKERS AND MONUMENTS GENERALLY; HEDGES, FENCES, BORDERS ETC:
ONLY ONE CENTRAL OR FAMILY MONUMENT SHALL BE PLACED ON A FAMILY LOT. CEMENT PADS INSTALLED FOR MONUMENT FOUNDATIONS ARE NOT TO EXCEED 18 INCHES WIDE AND SHALL BE 3 INCHES IN DEPTH. MARKERS SHALL BE LAID FLUSH WITH THE GROUND AND SHALL NOT EXCEED TWO FEET IN LENGTH AND ONE FOOT IN WIDTH. MARKERS SHALL BE PLACED AT THE END OF THE GRAVE MOST DISTANT FROM THE MONUMENT. NO COPING, CURB, FENCING, HEDGING, GRAVE MOUNDS, BORDERS OR ENCLOSURES OF ANY KIND SHALL BE ALLOWED ON ANY BURIAL LOT WITHOUT PERMISSION OF THE SUPERINTENDENT OF CEMETERIES AND THE TOWN MANAGER.

SECTION V MAUSOLEUM, STRUCTURES, ETC, GENERALLY:
NO MAUSOLEUM, TOMB, BUILDING OR OTHER STRUCTURE OF ANY KIND SHALL BE ERECTED ON ANY LOT WITHIN THE CEMETERIES OR WITHIN ANY EXTENSION OF THE CEMETERIES; PROVIDED, THAT MAUSOLEUMS AND TOMBS MAY BE CONSTRUCTED ON LOTS WHICH MAY BE DESIGNATED ON THE CEME¬TERY PLAT FROM TIME TO TIME BY THE BOARD OF COMMISSIONERS AS LOTS TO BE USED EXCLUSIVELY FOR THAT PURPOSE. IF ANY MAUSOLEUM, MONUMENT OR TOMB AT ANY TIME BECOMES UNSAFE, UNSIGHTLY OR IN NEED OF REPAIR OR RESETTING, THE SUPERINTENDENT SHALL NOTIFY THE OWNER OF THE LOT, OR ANY PERSON HAVING AN INTEREST IN THE LOT.

SECTION VI ASSIGNMENT OF SPACE OWNED BY PLOT OWNER:
WHEN THE OWNER OF A PLOT IN THE CEMETERIES DESIRE TO ASSIGN OR TRANSFER TO ANOTHER PERSON THE SPACE OWNED BY HIM, HE SHALL FIRST PRESENT HIS ORIGINAL CERTIFICATE OF OWNERSHIP TO THE NEW OWNER AND CANCEL THE OLD CERTIFICATE OF OWNERSHIP SO SURRENDERED, UPON PAYMENT OF FIFTY DOLLARS FOR EACH SEPARATE INSTRUMENT.

SECTION VII
THE TOWN CEMETERIES SHALL BE USED ONLY FOR THE BURIAL OF HUMAN DEAD

SECTION VIII INTERMENT OF MORE THAN ONE BODY IN A SINGLE GRAVE OR VAULT:
NO MORE THAN ONE BODY OR THE REMAINS OF MORE THAN ONE BODY SHALL BE INTERNED IN A SINGLE GRAVE OR VAULT, EXCEPT IN THE CASE OF A MOTHER AND HER NEW BORN BABY, OR TWO CHILDREN.
IN CASE OF CREMATION: CREMATIONS ARE TO BE PLACED IN A URN WHICH IS TO BE MADE OF A MINIMUM OF HEAVY DUTY PLASTIC MATERIAL. THERE MAY BE TWO REMAINS INTERRED INTO ONE GRAVE, EACH IN SEPARATE URNS; ONE AT THE HEAD OF THE GRAVE AND ONE AT THE FOOT OF THE GRAVE. AN EXCEPTION IN THE CASE OF A NEWBORN BABY/SMALL CHILD MAY BE MADE TO PLACE A THIRD URN IN THE CENTER OF THE GRAVE.

SECTION VIIII CERTAIN WORK TO BE DONE BY TOWN:
THE TOWN SHALL IN THE CEMETERIES UNDERTAKE AND PERFORM THE FOLLOWING WORK:
A. ALL GRADING, LANDSCAPE WORK AND IMPROVEMENTS OF ANY KIND.
B. ALL CARE OF PLOTS.
C. ALL PLANTING, TRIMMING, CUTTING AND REMOVABLE OF TREES AND SHRUBS.
D. ALL OPENING AND CLOSING OF PLOTS.
E. ALL INTERMENTS, DISINTERMENTS AND REMOVALS.

SECTION X TREES, SHRUBS, ETC. PLANTING:
NO PERSON SHALL PLANT ANY TREE, SHRUB, FLOWER, GRASS OR OTHER PLANT OF ANY KIND IN THE CEMETERY EXCEPT WITH THE APPROVAL OF THE SUPERINTENDENT. IF APPROVED, SUCH PLANTING WILL BE UNDER THE SUPERVISION OF THE SUPERINTENDENT OR HIS DESIGNATED REPRESENTATIVE.

SECTION XI TREES, SHRUB PRUNING OR CUTTING:
NO PERSON SHALL PLANT ANY TREE OR SHRUB EXCEPT WITH THE APPROVAL OF AND UNDER THE SUPERVISION OF THE SUPERINTENDENT OR HIS DESIGNATED REPRESENTATIVE.

SECTION XII RESPONSIBILITY OF TOWN FOR FLORAL PIECES, ETC:
THE TOWN SHALL NOT BE RESPONSIBLE FOR FLORAL PIECES, BASKETS OR FRAMES IN WHICH, OR TO WHICH, SUCH FLORAL PIECES ARE ATTACHED.

SECTION XIII EASEMENT FOR PASSAGE TO AND FROM PLOTS:
THE TOWN RESERVES TO ITSELF AND TO THOSE LAWFULLY ENTITLED THERETO A PERPETUAL RIGHT OF INGRESS AND EGRESS OVER PLOTS IN TOWN CEMETERIES FOR THE PASSAGE TO AND FROM OTHER PLOTS.

SECTION XIIII AUTHORITY OF TOWN MANAGER AS TO IMPROVEMENTS:
ALL IMPROVEMENTS OR ALTERATIONS OF LOTS OR PLOTS IN THE CEMETERIES SHALL BE UNDER THE DIRECTION OF, AND SUBJECT TO, THE CONSENT, SATISFACTION AND APPROVAL OF THE TOWN MANAGER AND OWNER OF SAID PLOT(S). IN THE EVENT AN AGREEMENT TO SUCH IMPROVEMENTS OR ALTERATIONS CANNOT BE REACHED BETWEEN THE TOWN MANAGER AND OWNER, SUCH REQUEST WILL BE SUBMITTED TO THE BOARD OF COMMISSIONERS FOR APPROVAL.
